Ciudades de Refugio (1-13).
1Cuando Yahvé, tu Dios, haya exterminado las naciones cuya tierra te dará, y las hayas desposeído, y habites en sus ciudades y en sus casas, 2te separarás tres ciudades de en medio de la tierra que Yahvé, tu Dios, te dará en posesión; 3allanarás los caminos y dividirás en tres regiones el territorio que Yahvé, tu Dios, te dará en heredad, para que todo homicida pueda refugiarse en esas ciudades. 4He aquí el caso en que el homicida que allí se refugie tendrá salva la vida: si mató a su prójimo sin querer, sin que antes fuera enemigo suyo ni ayer ni anteayer. 5Así, si uno va a cortar leña en el bosque con otro y, mientras maneja con fuerza el hacha para derribar el árbol, salta del mango el hierro y da a su prójimo y le mata, ése huirá a una de las ciudades, y tendrá salva la vida. 6Si no, el vengador de la sangre persiguiría en su furor al homicida, y, si el camino era demasiado largo, le alcanzaría y le heriría de muerte; y, sin embargo, ese hombre no merecía la muerte, pues que ni de ayer ni de anteayer tenía odio. 7Por eso te doy este mandato: Separa tres ciudades; 8y si Yahvé, tu Dios, ensancha tus fronteras, como a tus padres se lo ha jurado, y te da toda la tierra que a tus padres juró darte, 9siempre que guardes y pongas por obra todos los mandamientos que te prescribo hoy, amando a Yahvé, tu Dios, y siguiendo todos sus caminos añadirás a esas tres otras ciudades, 10para que no sea derramada sangre inocente en medio de la tierra que Yahvé, tu Dios, te dará por heredad y no caiga sangre sobre ti. 11Pero si uno que odiara a su prójimo le acechare, se echare sobre él y le hiriere mortalmente, y huyera a una de esas ciudades, 12los ancianos de la ciudad le mandarán prender y le entregarán en manos del vengador de la sangre para que muera. 13No tendréis piedad de él; quitarás de Israel sangre inocente y prosperarás.

Una vez más, el legislador habla de las ciudades de refugio1, que serán tres en la tierra prometida o Canaán. Deben estar convenientemente distribuídas, y en buenas condiciones los caminos que a ellas se dirigen, para que el homicida involuntario pueda encontrar refugio en ellas, protegiéndose contra el vengador de la sangre, que le buscará implacablemente por exigencias de la reciprocidad. Se prevén otras tres ciudades de refugio si el territorio de Israel se ensancha hacia Transjordania2. Substancialmente, la legislación y su aplicación es la misma que en los textos legislativos anteriores. El legislador no prohíbe el derecho de venganza expresamente, pero procura defender al inocente con estas ciudades de refugio. Naturalmente, el asesino no las puede utilizar, y caso de que se refugie en ellas, debe ser entregado al vengador de la sangre (v.12). Esta legislación deuteronómica parece ser anterior a la que hemos visto en el libro de los Números.

Cambio de Lindes y Prueba Testifical (14-21).
14No moverás los términos de tu prójimo de donde los pusieron los antepasados en la heredad de tu propiedad, en la tierra que Yahvé, tu Dios, va a darte en posesión. 15Un solo testigo no vale contra uno en cualquier delito o en cualquier pecado, cualquiera que sea el pecado. En la palabra de dos o tres testigos se apoyará la sentencia. 16Si surgiere contra uno un testigo malo, acusándole de un delito, 17los dos interesados en la causa se presentarán ante Yahvé, ante los sacerdotes y los jueces en funciones en ese tiempo,18quienes si, después de una escrupulosa investigación, averiguan que el testigo, mintiendo, había dado falso testimonio contra su hermano, 19le castigarán, haciéndole a él lo que él pretendía se hiciera con su hermano; así quitarás el mal de en medio de Israel. 20Los otros, al saberlo, temerán y no cometerán esa mala acción en medio de ti; 21no tendrá tu ojo piedad; vida por vida, ojo por ojo, diente por diente, mano por mano, pie por pie.

La propiedad se consideraba como algo sagrado, y por eso se prohibe cambiar los lindes fraudulentamente3. Entre los babilonios, estos mojones se llamaban kudurru, y llevaban símbolos de deidades, con amenazas contra los que los cambiaran4. Entre los romanos se veneraba al dios terminus, como custodio de la propiedad de los campos5.
El precepto legal del v.15 es una repetición de Num_35:30 y Deu_17:6. Un solo testigo no basta para fundamentar una sentencia. Las sanciones contra el falso acusador son también la sencilla aplicación de la ley del talión, establecida en Ex 21.235. Se determina el modo de probar el delito de acusación falsa. Para ello se acudirá al tribunal supremos establecido, integrado por sacerdotes y jueces en funciones6. A ellos toca investigar la malicia del acusador y fijar la pena al tenor del principio del talión. Los primeros artículos del código de Hammurabi tratan también de los falsos acusadores e imponen la ley del talión contra ellos, es decir, deben sufrir la pena que ellos querían imponer al acusado7.

Ciudades de refugio. Más allá de la mera protección a la vida de quien había asesinado a otro de manera involuntaria, esta ley, como la encontramos en Núm_35:9-28 y Jos_20:1-9, busca de manera especial salir al paso a la violencia extrema y al derramamiento de sangre ocasionados por cualquier lesión, voluntaria o involuntaria. Israel no estuvo exento de estos excesos y tuvo que haber corrido mucha sangre a causa de cualquier perjuicio, por leve que fuera. La misma Biblia denuncia y condena ese comportamiento (cfr. Gén_4:23s). De ahí, entonces, la necesidad de crear un espacio en el cual la vida de un homicida o agresor involuntario estuviera protegida y asegurada (1-10); sin embargo, ni estas ciudades, ni ningún otro lugar podían servir de refugio al agresor intencional: tenía que pagar con su vida el derramamiento de la sangre de su víctima (11-13).
El versículo 14 prohíbe el desplazamiento de los linderos de la propiedad. Aparentemente, no tiene conexión con la ley sobre las ciudades de refugio y su objetivo; sin embargo, es perfectamente lógico que en el contexto de una ley que busca ante todo proteger la vida se prohíba expresamente atentar contra aquello que proporciona la vida y el sustento al prójimo, su tierra, su heredad. Al parecer, en alguna época fue una práctica común en Israel; los insaciables terratenientes hacían de todo para acaparar y acaparar la tierra de los más pobres. El mismo libro de Reyes nos presenta un caso que ilustra perfectamente ese comportamiento que la Biblia repudia: la viña de Nabot (cfr. 1Re_21:1-19). No podemos dejar de denunciar esta tendencia, tan antigua y tan actual, y atacarla como algo contrario al plan de vida del Padre. El ser humano no se realiza como persona, como humano, en el aire, de manera abstracta; necesita de un espacio y lugar concretos para su realización personal, familiar y social; por eso es necesario incentivar especialmente en nuestros campesinos su derecho a la tierra y a denunciar con valentía todo acto de acaparamiento que, las más de las veces, va acompañado de terror y muerte.

Ciudades de refugio. A las tres ciudades de refugio provistas en la Transjordania (4:41-43) se sumarían tres más al lado occidental del río Jordán (v. 2); y todavía tres más si era necesario (v. 9). Su propósito era que si alguien era culpable de un homicidio accidental pudiera tener un lugar seguro de refugio de fácil acceso, en cualquier parte del territorio donde esto llegara a suceder (v. 3). Por supuesto, para otros no sería inmediatamente claro si la persona que buscaba refugio en la ciudad era realmente inocente. Por lo tanto, la ciudad no tenía el propósito de proveer protección incondicional a todo el que llegara. Sin embargo, el vengador de la sangre (que podía ser un familiar de la víctima, o un anciano de su ciudad), parece presumir la culpa del que causó la muerte. Entonces, el propósito de la ciudad era asegurar que cualquiera que fuera acusado de homicidio tuviera un juicio justo, en vez de quedar expuesto a la venganza de los familiares de la persona muerta. Los vv. 11 y 12 presuponen que cierto tipo de proceso legal se lleva a cabo para determinar la culpa o la inocencia (ver también Núm. 35:12).

En el caso de culpa la ofensa era capital, ya que el homicidio era una violación de la ley básica del pacto (5:17). La pena de muerte era impuesta a fin de librar a la tierra y al pueblo de este desafío al pacto (v. 13).

La ley en relación con cambiar los linderos de las propiedades (v. 14) no parece estar relacionada estrechamente con la provisión anterior ni con la que está a continuación. Sin embargo, era una falta seria, especialmente en una tierra donde no existían vallados ni cercas y donde la tierra era vida. Los abusos de esta índole por parte de terratenientes avaros, muy fácilmente podían conducir a los vecinos más débiles a la pobreza y esclavitud.
