1Yahvé habló a Josué, diciendo: 2Habla a los hijos de Israel y diles: Designad, como os lo mandó Moisés, las ciudades de asilo, 3donde pueda refugiarse el homicida que haya matado a alguno sin querer y le sirvan de refugio contra el vengador de la sangre. 4El homicida huirá a una de estas ciudades, se detendrá a la puerta de la ciudad y expondrá su caso a los ancianos de ella; éstos le recibirán entre ellos en la ciudad y le darán habitación donde more con ellos. 5Si el vengador de la sangre le persigue, no le entregarán en sus manos, porque sin querer mató a su prójimo, a quien de antes no odiaba. 6El homicida quedará en la ciudad hasta que comparezca ante la asamblea para ser juzgado y hasta la muerte del sumo sacerdote que entonces lo sea. En la organización social primitiva hebraica existía entre los individuos de la comunidad entera solidaridad. Toda ofensa hecha a un individuo se consideraba como una afrenta hecha a toda la comunidad. La sangre se vengaba con sangre. El pariente más próximo de la víctima debía ser el goel, el vengador de la sangre. A esta ley de la venganza, común a todo el antiguo Oriente, se refiere el autor en esta perícopa. En los v.4-6, que faltan en el texto griego, se compendia la legislación sobre la venganza, expuesta largamente en el libro de los Números (35:9-34) y Deuteronomio (19:1-15). El altar de Yahvé aseguraba el derecho de asilo cuando el homicidio era involuntario; de lo contrario, de mi altar mismo le arrancarás (al homicida) para darle muerte (Exo_21:14). Adonías se amparo en este derecho y salvó su vida (1Re_1:50-53); en cambio, Joab, que se refugió en el tabernáculo de Yahvé, encontró allí su muerte (1Re_2:31). Para los homicidas involuntarios había creado Moisés tres ciudades de refugio en TransJordania (Bosor, Ramot y Golán), una para cada tribu allí estacionada (Deu_4:43), y había ordenado que, una vez exterminadas las naciones de Palestina, se señalaran otras tres ciudades para las tribus cisjordánicas (Deu_19:1-2). Según Abel (Géographie 2:264), Bosor estaba quizá emplazada en el actual Umm el-amad, a catorce kilómetros al nordeste de Madaba; Ramot, en el actual tell Ramit, en la región de Galaad, a diez kilómetros al sudoeste de Derah; Basan hallábase en Golán, a unos veinticinco kilómetros al noroeste de Derah. Las tres ciudades escogidas Para las tribus de Cisjordania son: Cades de Neftalí (12:22; 19:37), a dieciocho kilómetros al norte de Safed; Siquem, en el centro del País y ciudad santa (Gen_12:6; Gen_33:18-20), y Hebrón, llamada también Quiriat Arbé (Gen_14:15; Gen_15:13-54). Ciudades de refugio

Como una medida práctica para asegurar justicia, Dios instruyó a Moisés para que Israel ubicara seis ciudades, tres a cada lado del Jordán, donde cualquiera que hubiere matado a una persona accidentalmente y sin premeditación, pudiera huir y encontrar asilo del vengador de la sangre (heb. go más precisamente, el protector de familia). Después de la conquista de la tierra al oriente del Jordán, Moisés estipuló con prontitud las tres ciudades allí (cf. Deut. 4:41-43; 19:1-13).

La sangre inocente, como la maldición, debe encontrar satisfacción. El Señor inquiere sobre y vindica la sangre inocente que clama por venganza (cf. Gén. 4:10; 9:5, 6; 2 Sam. 16:7, 8). La sangre homicida profana la tierra (Núm. 35:33), contamina las manos (Isa. 59:3) y pone de manifiesto el juicio del Señor (1 Rey. 2:31) y del protector de familia que está obligado a buscar justicia, no venganza, para su familia. La sangre inocente es expiada ya sea por la muerte del asesino (Núm. 35:33; Deut. 19:13) o por expiación (Deut. 21:7-9). De otra manera trae sobre la tierra la ira del Señor y desastre (2 Sam. 21; 1 Rey. 2:31-33; 2 Rey. 24:4). En esa luz -el lugar de la misericordia en el AT no ha sido examinado aquí pero ver Sal. 51, en particular v. 14-, uno ve la importancia de establecer en tribunales justos si la muerte fue deliberada o accidental. Si el acto fue deliberado, o sea asesinato, entonces la justicia demandaba sentencia de muerte; si fue accidental o no premeditado, entonces al culpable se le permitía vivir una vida normal en la ciudad de refugio.

Cuando el supuesto asesino llegaba a una ciudad de refugio, los ancianos, todos los levitas que eran responsables de enseñar la ley, le hacían un juicio preliminar a la puerta de la ciudad, en donde se asentaba el tribunal en el antiguo Israel. Si se le encontraba inocente, le daban asilo del protector de familia y lo enviaban a presentarse a juicio ante la asamblea, un tipo de parlamento premonárquico in vestido de poderes representativos y judiciales. Si esta asamblea de jefes o varones adultos lo encontraba culpable, lo entregaban al protector de familia para su ejecución. Si lo encontraban ino cente, lo enviaban de vuelta a la ciudad de refugio donde tenía que permanecer hasta la muerte del sumo sacerdote en funciones en ese tiempo. Permanecía allí para protegerlo a él y al protector de familia de una venganza como represalia. Quizá la muerte del sumo sacerdote, el representante principal de Israel ante Dios, podría decirse que simboliza la muerte expiatoria de Jesucristo, el sumo sa cerdote de la iglesia, quien ofreció satisfacción por todos los pecados, tanto intencionales como no intencionales.

*20 Cuando se producía un homicidio, el vengador de la sangre restablecía la justicia dando muerte al homicida. Pero si el homicidio era involuntario, o por lo menos no premeditado, el homicida se refugiaba en el santuario y se agarraba al cuerno del altar (Éxo 21:12-14; Re 2:28-352:28-35). Había dos modos de poner fin a la situación: comparecer en juicio ante la comunidad o que muriera el sumo sacerdote (quizá, a la muerte de este, se proclamaba amnistía general y el nuevo consagrado ofrecía un sacrificio por los pecados involuntarios del pueblo: Lev 8:15).
