5. Leyes y Ordenaciones Varias.
D espués de haber organizado militarmente el personal del campamento, el legislador aborda la organización moral de las gentes que en él conviven conforme a determinados postulados religiosos. Así, en este capítulo se trata de: a) exclusión de los impuros (1-4); b) restitución de lo mal adquirido (5-10); c) ley sobre los celos (11-31). En este mosaico de leyes, sin duda que hay infiltraciones legislativas de épocas posteriores a la estancia en el desierto de los israelitas.

Exclusión de los Ritualmente Impuros.
1Habló Yahvé a Moisés, diciendo: 2Manda a los hijos de Israel que hagan salir del campamento a todo leproso, a todo el que padece flujo y a todo inmundo por un cadáver. 3Hombres o mujeres, todos los haréis salir del campamento para que no contaminen el campamento en que habitan. Así lo hicieron los hijos de Israel, haciéndoles salir del campamento; 4como lo ordenó Moisés, así lo hicieron los hijos de Israel.

El campamento estaba organizado en torno al tabernáculo de Dios, como centro de su vida religiosa, y por eso era en cierta manera cosa sagrada. El arca de la alianza era símbolo de la presencia de Dios, la cual santificaba el territorio ocupado por el campamento. Por tanto, debían ser excluidos de esa zona todos los que de cualquier modo hubieran contraído impureza ritual, como el leproso1, el que padeciera de gonorrea2 o hubiera tocado un cadáver3. En el fondo de estas prescripciones hay razones de higiene (necesarias sobre todo en una vida campamental) y razones religiosas ancestrales, tomadas del ambiente tribal de la época. Los contaminados por alguna de estas impurezas no debían residir en el campamento, ya que lo contaminaban, y podía desencadenarse la ira abrasadora de Yahvé.

Restitución de los bienes mal Adquiridos (5-10).
5Habló Yahvé a Moisés, diciendo: 6Di a los hijos de Israel: Si un hombre o mujer comete uno de esos pecados que perjudican al prójimo, prevaricando contra Yahvé y haciéndose culpable, 7confesará su pecado y restituirá enteramente el daño, añadiendo un quinto; restituirá a aquel a quien perjudicó; 8 y si no hubiera ya nadie a quien pertenezca, la restitución la hará a Yahvé, y será entregada al sacerdote, además del carnero expiatorio con que se hará la expiación del culpable. 9Toda ofrenda de cosas consagradas por los hijos de Israel que éstos presentan al sacerdote, de éste es; 10cuanto cada uno consagre, de él es; lo que se presenta al sacerdote, de éste es.

Esta perícopa parece fuera de lugar, y es paralela a la sección de Lev_5:20ss, en que se trata de la misma materia. Como allí, se recarga en un quinto la indemnización de los perjuicios causados al prójimo y se añade el sacrificio de un carnero en expiación del pecado cometido contra Dios. Si faltase la persona perjudicada u otra heredera de sus derechos, para que el infractor no se beneficie de su culpa, entregará la restitución a Yahvé, representado en el caso por los sacerdotes. Todo robo es un delito contra Dios, pues afecta a los derechos divinos, ya que Dios es el único dueño de los bienes y los distribuye a su beneplácito. De ahí la necesidad de un sacrificio en reparación. Después el legislador habla de los derechos de los sacerdotes en los sacrificios y ofrendas4.

Ley de los Celos (11-31).
11Habló Yahvé a Moisés, diciendo: 12Habla a los hijos de Israel y diles: Si la mujer de uno fornicare y le fuese infiel, 13durmiendo con otro en concúbito de semen, sin que haya podido verlo el marido ni haya testigos, por no haber sido hallada en el lecho, 14y se apoderare del marido el espíritu de los celos, y tuviese celos de ella, háyase ella manchado en realidad o no se haya manchado, 15la llevará al sacerdote, y ofrecerá por ella una oblación de la décima parte de un efá de harina de cebada, sin derramar aceite sobre ella ni poner incienso encima, porque es ofrenda de celos, ofrenda de memoria para traer el pecado a la memoria. 16El sacerdote hará que se acerque y se esté ante Yahvé; 17tomará del agua santa en una vasija de barro, y, cogiendo un poco de la tierra del suelo del tabernáculo, la echará en el agua.18Luego él sacerdote, haciendo estar a la mujer ante Yahvé, le descubrirá la cabeza y le pondrá en las manos la ofrenda de memoria, la ofrenda de los celos, teniendo él en la mano el agua amarga de la maldición; 19y la conjurará, diciendo: Si no ha dormido contigo ninguno y si no te has descarriado, contaminándote y siendo infiel a tu marido, indemne seas del agua amarga de la maldición; 20pero si te descarriaste y fornicaste, infiel a tu marido, contaminándote y durmiendo con otro, 21el sacerdote le conjurará con el juramento de execración, diciendo: Hágate Yahvé maldición y execración en medio de tu pueblo, y seqúense tus muslos e hínchese tu vientre, 22entre esta agua de maldición en tus entrañas, para hacer que tu vientre se hinche y se pudran tus muslos; la mujer contestará: Amén, amén. 23El sacerdote escribirá estas maldiciones en una hoja y las diluirá en el agua amarga, 24y hará beber el agua amarga de la maldición. 25Luego tomará de la mano de la mujer la ofrenda de los celos y la agitará ante Yahvé y la llevará al altar; 26y, tomando un puñado de la ofrenda de memoria, lo quemará en el altar, haciendo después beber el agua a la mujer. 27Darále a beber el agua; y si se hubiere contaminado, siendo infiel a su marido, el agua de maldición entrará en ella con su amargura, se le hinchará el vientre, se le secarán los muslos y será maldición en medio de su pueblo. 28Si, por el contrario, no se contaminó y es pura, quedará ilesa y será fecunda. 29Esta es ley de los celos para cuando una mujer haya sido infiel a su marido y se haya contaminado, 30o que el espíritu de los celos se haya apoderado de su marido y tenga celos de ella; presentará a su mujer ante Yahvé, y el sacerdote hará con ella cuanto en esta ley se prescribe. 31Así el marido quedará libre de culpa, y la mujer llevará sobre sí su pecado.

Aquí tenemos un verdadero juicio de Dios, una ordalía. La fe simplista en la justicia de Dios dio origen a muchos de estos métodos bárbaros de averiguar la verdad, cuando no poseían otros medios seguros para lograrlo ni se querían resignar a la ignorancia de ella. Estos medios, empleados por el vulgo, podían ser ocasión de muchos abusos, y la religión intervino para regular su empleo. En las colecciones de la liturgia antigua tenemos muchos formularios que tienden a regular las ordalías inventadas por la superstición popular. Tales son el juicio por el fuego, por el agua, por la reja de arado candente5. El ritual bíblico es bastante inofensivo en comparación con estas prácticas brutales: se hacía beber agua con un poco de polvo del santuario, con la ceniza de una hoja de papiro en que iban escritas ciertas maldiciones. El formulario tiende a impresionar a la mujer y obligarla a confesar su crimen ante el santuario. Entre los babilonios y asirios, el Eufrates y el Tigris, como otras tantas divinidades, tenían el poder de discernir la verdad, ahogando al culpable y salvando al inocente6.
La mujer debe presentar una ofrenda modesta de cebada (unos tres kilos y cuarto: la décima parte de un efá), sin aceite ni incienso, como era lo normal, pues no tiene la finalidad de presentarla en homenaje a Dios, sino más bien para impetrar el auxilio divino para que aclare la sospecha; es oblación de celos (v.15). El agua santa (v.17) aparece sólo aquí en todo el Antiguo Testamento. Los LXX leen agua pura viviente, es decir, corriente7. El vaso que la contiene debe ser roto después del rito8. En señal de deshonra, el sacerdote descubre la cabellera de la mujer9. El agua amarga se llama así por la amargura que va a sufrir la culpable. Después el sacerdote conjura a la mujer para que se manifieste su culpabilidad ñ inocencia. Este rito refleja una mentalidad muy arcaica en la historia de Israel, eco de costumbres ambientales de la estepa del Sinaí. De hecho apenas se menciona en épocas posteriores en la historia israelita.

La esposa sospechosa de infidelidad. Este es otro ejemplo donde se viola la confianza, esta vez entre el esposo y la esposa. En este caso el esposo sospecha que su esposa ha cometido adulterio; dicha infidelidad es causa de impureza y destruye el compañerismo con Dios. Si hubiera testigos, lo que seguiría sería la pena de muerte (Gén. 20:3; Lev. 20:10; Deut. 22:22). Pero sin testigos, ningún juez podía condenar en base a la mera sospecha. Donde había duda, el asunto debía dejarse en la manos de Dios quien conoce todas las cosas. El sacerdote tenía que llevar a cabo un ritual, haciendo que la mujer bajo sospecha tomara una maldición sobre sí misma. Su respuesta, AmeŒn, significa que esto sea una realidad en mi caso (ver Deut. 27:14-26). Si era culpable, la maldición caería sobre ella: Jehovah te haga maldición y juramento en medio de tu pueblo (v. 21). El pensamiento de que la maldición se encarnaría en ella se expresaba en el ritual (vv. 23-28). El sacerdote escribía la maldición en un rollo, lavaba las palabras con agua y la mujer la bebía. Esto no era magia, y no había ninguna sustancia dañina en la tinta. Los materiales de escritura probablemente lo constituían un rollo de piel y la tinta que se hacía de pigmento negro o tizne mezclado con agua y goma, materiales que ya estaban disponibles en el desierto. La imprecación era poderosa porque se pronunciaba delante del Señor (v. 16), quien conoce el corazón, y él haría que la maldición fuera efectiva si la mujer era culpable.

Nota. El lenguaje del v. 23 nos brinda la oportunidad de discernir el significado de escrituras posteriores. Leemos que Cristo nos redimió de la maldición de la ley al hacerse maldición por nosotros (Gál. 3:13); aunque no era culpable, él sufrió la maldición en su propio cuerpo. De igual manera, Isaías profetiza que el Siervo del Señor sería puesto como pacto para el pueblo (Isa. 42:6; 49:8). Y así como el Siervo encarnó el pacto, Pablo expresa su confianza de que todas las promesas de Dios se confirman en Cristo Jesús (2 Cor. 1:20).

Legislaciones varias. Estos dos capítulos están dedicados a la legislación sobre aspectos varios de la vida del pueblo. El motivo fundamental de estas leyes es la preocupación por lograr un culto lo más perfecto posible, que implica necesariamente la pureza de la asamblea. Recordemos que en la mentalidad de la escuela teológico-literaria sacerdotal (P) Israel es, ante todo, una comunidad cultual que hace posible la presencia permanente de Dios entre ellos mediante la pureza en todos sus órdenes. De ahí que las leyes y normas para el culto y la disposición personal afecten a todos los aspectos de la vida humana: aspecto físico o salud corporal (5,1-4); aspecto social, en lo referente a las relaciones de propiedad (5,5-10); aspecto familiar, en lo relativo a las relaciones de pareja (5,12-31); finalmente, el aspecto religioso (6,1-21), concerniente a la costumbre de consagrarse al Señor mediante un voto, llamado «voto de Nazireato».
Como puede verse, son leyes y exigencias propias de un determinado modo de pensar, de la llamada escuela teológico-literaria sacerdotal (P). Los sacerdotes son los que juzgan, determinan y realizan los distintos ritos de normalización y restablecimiento del orden que había sido roto; son los únicos que tienen la potestad de bendecir al pueblo según una fórmula establecida (6,22-26).

*5:11-31 El adulterio es un delito muy grave, que merece la muerte (Lev 20:10; Deu 22:22). Si no se puede probar, se busca la solución en una ordalía o juicio de Dios, práctica muy antigua que se mantuvo hasta la Edad Media para juzgar causas en las que no existían pruebas. Esta forma, por las aguas amargas y malditas, no tiene paralelo en otras culturas. Es una vieja práctica adaptada a Israel por la intervención del sacerdote, la ofrenda y el juramento. No consta que se aplicara nunca. Que se considere únicamente el caso de la mujer presuntamente adúltera y no el del varón era común a todos aquellos pueblos.

16-28. Entre los pueblos primitivos, la falta de pruebas para declarar culpable a una persona, se sustituye con un rito que apela al juicio de Dios. En el caso presente, las "aguas amargas, portadoras de maldición", deben provocar la esterilidad en la mujer culpable. Este es un grave castigo en una sociedad que consideraba la esterilidad como un oprobio.
